Terms and Conditions (T&Cs) Swiss Secondhand Shop
1. Validity of the General Terms and Conditions and conclusion of contract
These General Terms and Conditions (GTC) apply to purchase contracts of any kind that are concluded via this website.
The GTC can be viewed and read on the Internet. If a customer does not agree with the GTC in such cases, they can exercise their right of withdrawal in writing. Swiss Secondhand Shop reserves the right to amend or change the GTC at any time. The version of the GTC valid at the time of the order applies.
2. Acceptance of goods
Swiss Secondhand Shop sells well-maintained clothing without stains or holes, as well as clothing with stains and minor defects, which are listed in the product description as “INFO.” No liability is accepted for stains and other defects, as the customer must read the description carefully before placing an order. Shoes and bags are used or in mint condition; here too, defects may be present, but these are indicated in the product description and reflected in a fair price. Rapid wear and tear of the products is not covered by liability. We sell these products or transform them into something beautiful so that they are not simply thrown away! We reserve the right to refuse liability without justification. The customer declares bindingly and is liable that the goods handed over are his property.
3. Pricing
Prices are set by Swiss Secondhand Shop. Customers can request price quotes and volume discounts via direct message on Instagram. Prices are quoted in CHF.
Swiss Secondhand Shop reserves the right to change prices at any time. Prices published on the website on the date of order are binding for customers.
4. Delivery terms
Delivery within Switzerland normally takes place within 1–4 business days after receipt of payment on the day of delivery confirmation. If a longer delivery period is necessary, the customer will be informed at the latest after this period has expired. The seller does not provide any guarantees for the duration of deliveries outside Switzerland.
For payments via IBAN, a maximum period of seven working days applies. After this period has expired, the customer will be contacted by SMS/email or Instagram and the deadline will be extended again. If this deadline is not met, legal consequences will follow.
For deliveries within Switzerland, the shipping costs are the standard shipping costs of Swiss Post for large parcels and small shipments.
If the delivery of the goods fails due to the fault of the customer, Swiss Secondhand Shop may withdraw from the contract.
No claims for damages can be made for incomplete, defective, or missing goods or for delays in delivery.
The goods remain the property of Seiss Secondhand Shop until full payment has been received.
With the pick-up payment method, the customer can collect the ordered items from the shop. The goods must be collected in Neuenegg within 7 days. If this deadline cannot be met, the customer must contact us (Instagram/email). If the customer fails to do so, the order will be canceled after 7 days and the goods will be offered for sale again!
5. Returns/return shipments
We do not accept returns of purchased goods, as we want to generate as little traffic as possible with our packages. This helps protect the environment, even if only a little.
If an item of clothing does not fit, the customer can let us know so that we can take note of this. The customer must check the size information and contact Swiss Secondhand Shop if they have any questions before making a purchase.
6. Right of exchange
There is no right of exchange for goods, unless the goods were damaged or lost during delivery. If goods do not arrive, the customer must contact us immediately via Instagram (@swiss.secondhand.shop) or email. If the goods are lost by the customer, the item will not be exchanged and the amount will not be refunded.
7. Liability
We accept no liability for burglary, fire, water damage, or force majeure. Furthermore, any liability for theft or damage is also excluded.
Swiss Secondhand Shop is not liable for defects and malfunctions for which it is not responsible, especially not for safety defects.
Furthermore, Swiss Secondhand Shop is not liable for force majeure, improper handling and disregard of risks on the part of the customer or third parties, excessive strain, unsuitable operating materials of the customer or third parties, extreme environmental influences, interventions by the customer or malfunctions caused by third parties (viruses, worms, etc.) that occur despite the necessary current security measures.
8. Application of law and place of jurisdiction
These GTC are governed by Swiss law, namely the provisions of the Swiss Code of Obligations.
The place of jurisdiction is the registered office of the provider.
